2. Services and Scope

We will provide the photography services and deliverables written in the Booking Details. Anything not listed there is not included.

Please check the Booking Details carefully before you sign. If the event or session changes in a big way (for example, a courthouse ceremony or elopement becomes a full wedding, or the guest count, wedding party, number of locations, or coverage needs grow significantly), we may need to send a revised quote. Expanded services are not included at the original price. If we can't agree on revised terms, the original scope stays in place.

3. Booking, Deposit and Payments

3.1 Booking. You can book online through goldlensphotography.com or directly with Faythe. Your date is reserved only after (a) you accept this Agreement and (b) your deposit is paid. Until both happen, the date is not held. A session request that hasn't been paid and confirmed is not a booking.

3.2 Non-refundable deposit. A deposit of 50% of your total package price (rounded to the cent) is due at booking for every package. For example, the deposit for a $325 session is $162.50, and for a $4,500 wedding it is $2,250.

The deposit is non-refundable, except as stated in Sections 5.3 (if we cancel) and 6 (weather and events beyond anyone's control). It is not an extra fee: the full deposit is applied to your total price. The deposit pays us for holding your date, turning away other bookings, and planning work that starts as soon as you book.

3.3 Balance due date. Unless the Booking Details say otherwise:

3.4 How to pay. The deposit is paid at booking, online by card through Stripe, our payment processor, or another way we agree to in writing. We don't see or store your full card number. The balance is paid in person at the time of service by cash, or by another method Faythe accepts (for example Venmo or check). The balance is not charged to your card through the website. If a fee applies to a specific payment method, we will tell you before you pay.

3.5 Unpaid balance. If any part of the balance isn't paid at the time of service, we will send a reminder, and we may hold the gallery until all undisputed amounts are paid.

3.6 Payment disputes. If you think a charge is wrong, please contact us first so we can fix it. Please don't open a card dispute (chargeback) before giving us a chance to respond.

3.7 Gratuities. Tips are always optional and never required.

4. What You Receive

4.1 Image count. You will receive the exact number of edited images stated in your package. Image counts are not "minimums" and are not estimates. Additional edited images are not free; you can buy them at the extra image rate in the Booking Details. Wedding sneak peek images count toward your total and are included again in your full gallery.

4.2 Wedding sneak peek. Wedding packages include 10–20 sneak peek images delivered within 24–48 hours after the wedding. Sneak peeks are for weddings only and are not included with portraits, elopements, headshots or mini sessions unless written in the Booking Details.

4.3 Delivery timeline. Your full gallery is delivered within 4 to 6 weeks after your session or event. Exceptions: Headshot Bronze is delivered within 72 hours; a paid rush gallery is delivered within 7 days; and the engagement session included with a wedding package follows the 4–6 week timeline from the engagement session date. The timeline starts once any images you need to choose (if applicable) and all payments due are received. If illness, emergency, equipment or software trouble, or events beyond our control cause a delay, we will tell you as soon as we reasonably can and give you a new date.

4.4 Client portal. Galleries are delivered through your private, password-protected Gold Lens Client Portal, where you can view, favorite and download your images. Please keep your login private. You are responsible for anyone you share your login or gallery link with.

4.5 Editing style and selection. Faythe chooses which images to edit and deliver and edits them in her signature style, consistent with her portfolio. This includes color and light correction and, where she chooses, black-and-white versions. Basic retouching (for example, temporary blemishes) is included. Heavy retouching, such as body reshaping or removing objects or people, is not included unless written in the Booking Details. If you notice a technical problem with a delivered image, let us know within 30 days and we will fix it. Re-editing in a different style is not included.

4.6 No RAW files. RAW files, unedited images and images not selected for delivery are not provided, for sale or otherwise.

4.7 Gallery availability and archive. Your gallery stays available in the client portal for 12 months after delivery. Please download and back up your images during that time. After it expires, we will try to keep an archive copy for at least 1 more year, but we can't promise it. We can reopen an expired gallery for a fee of $50 if the files are still available.

4.8 Prints. Gold Lens Photography does not produce, sell or handle prints, albums or other physical products. You may order prints through our third-party print lab (Pic-Time), linked from your portal, or print at any lab you choose under the print release in Section 8.2. Pic-Time orders are a separate purchase from Pic-Time and are covered by Pic-Time's terms and privacy policy. Pic-Time is responsible for print quality, shipping, returns and refunds for those orders. Ordering prints is optional.

5. Cancellation and Rescheduling

5.1 If you cancel. You must cancel in writing (email is fine). The deposit is kept. For any amount you paid beyond the deposit:

Any amount we keep is meant to be a reasonable estimate of our loss from holding the date, not a penalty.

5.2 If you reschedule. You can ask to reschedule in writing. We allow one reschedule at no charge if you ask at least 14 days before the date (7 days for portraits, headshots and minis) and the new date is within 12 months and open on our calendar. Your deposit and payments move to the new date. Further reschedules, or a reschedule to a date when prices have gone up, may require a new deposit or a price difference, which we will agree in writing first. Mini sessions are held on set dates, so they can only move to another available mini session slot. If no new date works, the cancellation terms in Section 5.1 apply.

5.3 If we cancel. If Faythe can't photograph your booking because of illness, injury, emergency or another reason she can't control, she will try to find a qualified replacement photographer you approve, and she will still do the editing and delivery where possible. If you don't approve a replacement or none is available, we will refund all payments you made, including the deposit, or move your booking to a new date if you prefer. If we cancel for any other reason, we will refund all payments, including the deposit.

5.4 Limit. A refund under Section 5.3 is your only remedy against us if we cancel, except as the law requires otherwise.

6. Weather, Smoke and Events Beyond Anyone's Control

The Methow Valley has wildfire smoke, snow, heat, closed passes and road closures. Outdoor sessions depend on weather and light. For portraits, headshots, minis and elopements, if Faythe decides conditions are unsafe or will seriously hurt the photos, we will reschedule together at no charge and your deposit moves to the new date. Weddings go ahead rain or shine unless it is unsafe, and Faythe will adapt where she can.

Neither of us is in breach if something beyond reasonable control, such as severe weather, wildfire or smoke, natural disaster, road or pass closures, government orders, public health emergencies, or serious illness, prevents or seriously delays performance. The affected person will tell the other as soon as reasonably possible. We will first try to reschedule, with all payments moving to the new date. If the event can't be rescheduled within 12 months, we will refund all payments beyond the deposit, and we will refund the deposit too if we were the ones who couldn't perform.

7. Your Responsibilities

7.1 Information. You will give us an accurate timeline, important shots and family groupings, venue addresses, a day-of contact person, and access instructions at least 14 days before a wedding or elopement and at least 2 days before other sessions.

7.2 Venue rules and permits. You are responsible for getting any needed venue, landowner or land-agency permission (including permits for sessions on public land, if required) and for telling us about rules set by the venue or officiant. Some rules, such as no flash or no movement during the ceremony, will limit the photos.

7.3 Lighting and conditions. Dark venues, colored lighting, haze and similar conditions can affect image quality. We will work with the light available, but we can't guarantee results in poor light.

7.4 Guests and other photographers. Faythe is your hired photographer for the event. Other hired photographers or videographers are welcome if you tell us ahead of time so we can coordinate. Guests with phones or cameras can block shots, especially during the ceremony. We will work around them where we can, and we encourage an "unplugged" ceremony announcement, but we are not responsible for photos blocked or spoiled by guests, vendors or others.

7.5 Timing. Coverage starts and ends at the times in the Booking Details. Late starts, delays and running behind don't extend coverage. Extra coverage needs your approval (a verbal or text approval on the day is fine) and is billed at the extra coverage rate. Faythe may decline extra coverage if she isn't available or it would be unsafe.

7.6 Meals and breaks. For weddings with more than 6 hours of coverage, you will provide Faythe (and any second shooter) a meal and a 30-minute break, usually while guests eat. Faythe will time breaks to avoid missing key moments.

7.7 Safety. Faythe may stop or change a session if continuing would be unsafe, unlawful, or if she is harassed or threatened. Coverage stopped for that reason is not refunded.

7.8 No guarantee of specific shots. We will use our professional skill to capture your day, but we can't guarantee any specific image, moment or person.

8. Copyright and Your Print Release

8.1 Copyright. Photographer owns the copyright in all images and related creative work.

8.2 Your personal-use license and full print release. Once you have paid in full, you get a personal-use license and full print release for your delivered images. This means you and your family may, without a time limit:

The license does not allow you to sell or license the images, use them to advertise a business or product, enter them in contests, or apply filters or heavy edits and then present them as Gold Lens work, unless we agree in writing. Headshot clients may also use their headshots for their own professional profiles, websites and personal branding. Vendors (for example, your venue or florist) need to ask us separately to use images.

9. Portfolio and Marketing Use

We would love to share your images in our portfolio, website, social media, blog and advertising. We will only do so if you choose Yes below. You may change your mind at any time by emailing us. If you opt out later, we will stop new uses and remove images from our website and social media posts we control within a reasonable time, but we can't recall printed materials or posts others have already shared. Saying no does not change your services or price. We never publish your contact information.

Even without marketing consent, Faythe may show images privately to you or your family and keep copies for her records and archive.

10. People in the Photos and Minors

You confirm you have permission from people you bring to a portrait session to be photographed. If a person in a session is under 18 (including high school seniors), a parent or legal guardian must sign this Agreement and give the consents in Section 9 for that minor, and a parent, guardian or adult they approve must be present for the session. You can only give marketing consent for yourself and your minor children. For weddings and events, Faythe will only use images of guests for marketing in the ways allowed above and will honor a guest's request to remove an image of them.

11. Travel

Travel within the Methow Valley and anywhere in Okanogan County is free. For locations outside Okanogan County, the first 60 miles round trip, measured from Carlton, Washington, are free, and each additional round-trip mile is $0.65. If an overnight stay is reasonably needed (for example, a very early start or late end far from Carlton), you will pay for lodging at cost, which we will agree with you in writing before booking it. Travel and lodging costs will be listed in the Booking Details or invoiced and are due as stated in Section 3.3.

12. Equipment Failure and Lost Files

Faythe uses professional equipment, carries backup gear, and backs up images. Cameras, memory cards, computers and storage can still fail. If equipment failure, damaged media, theft, accident or another technical problem affects your images, we will make reasonable efforts to recover them. If images can't be recovered, we will offer to reshoot portraits, headshots or minis at no charge where that is possible. For weddings, elopements or anything that can't be reshot, our responsibility is a refund of the part of the price for the lost or unusable images or coverage, up to the total amount you paid, as described in Section 13.

13. Limit of Liability

To the fullest extent Washington law allows:

These limits do not apply to liability that the law does not allow to be limited, including liability for gross negligence or intentional misconduct.

14. Indemnity

Each of us will be responsible for, and will cover the other's reasonable costs of, third-party claims caused by our own breach of this Agreement, negligence or unlawful conduct. You will also be responsible for claims arising from venue or permit requirements you were responsible for, or from instructions or materials you gave us (for example, if you ask us to photograph a location without permission). Neither of us has to cover the other for the other's own negligence or misconduct.

15. Disputes and Governing Law

If a disagreement comes up, we will first try to resolve it by talking or exchanging emails in good faith for at least 30 days. If that doesn't work, either of us may suggest mediation with a mediator we agree on, with costs shared equally. If the disagreement still isn't resolved, either of us may go to court. Either of us may file in small claims court at any time for a claim within its limits.

This Agreement is governed by the laws of the State of Washington. Any court case must be filed in the courts located in Okanogan County, Washington, unless the law requires a different place.

16. Online Acceptance and Electronic Signatures

You may accept this Agreement electronically, for example by checking an "I agree" box during online booking, typing your name, or signing through an e-signature service. An electronic acceptance or signature has the same effect as a handwritten one. We keep a record of the version you accepted, the date and time, and the information you entered, and we will make a copy available in your client portal or by email.

17. General Terms

17.1 Entire agreement. This Agreement, including the Booking Details and Exhibit A, is the whole agreement between us about these services. It replaces earlier conversations and messages about the same booking. Website descriptions, Terms of Use and FAQs do not change this Agreement; if they conflict, this Agreement controls.

17.2 Changes. Any change must be in writing (email is fine) and agreed to by both of us.

17.3 Severability. If a court finds any part of this Agreement unenforceable, that part will be limited or removed only as much as needed, and the rest of the Agreement stays in effect.

17.4 Assignment. You can't transfer this Agreement to someone else without our written approval. We may use a qualified replacement or assistant photographer as described in Section 5.3.

17.5 Independent business. Faythe works as an independent business, not as your employee.

17.6 Notices. Notices under this Agreement can be sent by email to the addresses in the Booking Details and to [email protected].

18. Signatures

By signing (or accepting online), you confirm you have read this Agreement, had the chance to ask questions or get your own legal advice, and agree to it.
